Trading Terms and Conditions
These Trading Terms are obligatory for both the operator/supplier on the one hand and the customer/user on the other, and they determine the supplier's and customer's conditions in the field of sale of goods or providing services in the Hemi-Sync-4eu.com online shop.
We encourage all customers, to become familiar in addition to these terms and conditions, also with information on the page What you need to know, where are important information about the type and nature of the goods we sell in the eshop on www.hemi-sync-4eu.com.

2) Name and main characteristics of products or services
Sale of the CDs with the registered Hemi-Sync® technology by means of internet websites, or via e-mail. We have a right to trade, sale and store products with the Hemi-Sync® technology and we have made the proper contract with Interstate Industries, Inc., trading under the name of Monroe Products.
2-1) The characteristics of the products are stated clearly enough on the homepage of the e-shop. There is a description of every CD, taken from the Hemi-Sync.com website, by each of them.
3) The price of goods or services including all taxes and delivery costs
We are taxpayers and the prices for goods or services are inclusive of VAT and are therefore final. The total price consists of the sum of prices for goods + price for postage and packing. Before sending the order the customer/consumer is informed about the total price of products and the price for delivery. Prices for shipping vary depending on country of delivery and the quantity of goods. When larger quantities of goods may be higher postage. In some EU countries is higher postage than in others.
Postage and packing charges will be added to all orders.
Prices for postage to the EU countries starting at EUR 7,50 + EUR 1 packing charge.
3-1) Customers understand and they are familiar with the fact that prices for the products may change from time to time, mainly when our supplier changes the prices or in the cases more significant changes in the exchange rate of U.S. dollar against the Czech crown. If such a change of prices came into being, it would not affect previously made orders.
3-2) We deliver to the EU countries: Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark (except for the Faeroe Islands and Greenland), Estonia, Finland, France, Germany (except for the Helgoland Island and the Büsingen area), Greece, Hungary, Ireland, Italy (except for the municipalities of Livigna and Campione d'Italia), Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain (except for Ceuty and Melilly), Sweden, United Kingdom.
4-1) Orders of products become to be considered obligatory for both the contracting parties at the moment the order is sent via the electronic form by a customer. The customer has to fill in true information about him/her, mainly his/her name and surname, e-mail address and the address the ordered products should be delivered to. The customer has to state the sort and the quantity of the products he or she is ordering and the way of payment, by which he or she pledges to pay for the ordered goods.
4-2) Before sending the form, the customer is familiarized with the total price, include the prices for particular items, of which the total price is consisted, and his/her attention is drawn to these Trading Terms and Conditions and they begins to be obligatory to him/her.
4-3) By sending the electronic form, the customer/consumer agrees to pay the supplier the total price in the required amount.
4-4) Usual expedition time of goods that are in stock are 3 days. Expedition time of titles that are currently not in stock is subject to negotiation. On the detail of the product, the customer learns whether the individual CD titles are, or are not in stock, and accordingly may send an inquiry through the contact form, asking when the product will be in stock.
4-5) Products are delivered through postal services to the customer's address. If the customer is not available at the time when the package is being delivered, the package is stored at the post-office and the addressee is notified about keeping the package at the post-office by a written notice. If the ordered products were not delivered within 14 days, customers are asked to contact the post-office, where his/her packages are usually stored, whether the package is stored there or not. The loss of written notification of storage the package at the post-office is not rare.
5) The right of withdrawal from contract in accordance with law 367/2000 Coll. in accordance with §53, paragraph 6, except for the cases mentioned in paragraph 7
If the contract was concluded by means of distance communication, the consumer has the right to cancel the contract within 14 days from the acceptance of performance.
In accordance with the law 367/2000 Coll. according to § 53 paragraph 7 letter d) the consumer can not withdraw from the contracts for delivery of audio and video recordings and computer programs, if the consumer destroyed their original packaging.
5-1) The customer has the right to cancel the contract within 14 days from receipt of goods, if he not break on the supplied CD or DVD their original packaging. If you break the original packaging, it is pointless to request the withdrawal from the contract. The law in this case is clear.
5-2) If a customer has not broken the original package and wishes to withdraw from the contract within a specified period, then should follow the instructions mentioned below.
a) Inform the supplier of his intention to withdraw from the contract via e-mail.
b) Sends a clean and undamaged goods in the original packaging to the address of supplier by registered post.
c) The goods must be sent in protective packaging in order not to come to damage of the product on the way to the supplier, otherwise the supplier may assume that the product had been damaged before it was sent and he may refuse to refund money to the customer.
d) The purchase document or its copy must be sent, together with the goods.
5-3) If the goods is returned in good order in accordance with the instructions above, the supplier will refund the amount of money that was paid for the goods. The amount of money will be returned to the customer. The way of payment will be arranged with every customer individually.
5-4) If some of the conditions above is broken, the supplier will not accept withdrawal from the consumer contract and the goods will be returned to the customer to his/her address.
In our online shop, we provide the same claiming conditions as in a usual shop. In accordance with the valid Czech Commercial Code and the Civil Code.
We provide a 90 days warranty for our goods (from the delivery date). This limitation is specified in conformity with VISA and MasterCard regulations.
7) Personal Data Protection
We fully respect customers' privacy and all our data are kept in secret and we use them only for the sales accounting service and for shipping the goods to the customer's address. No personal data will be used for any other purpose, neither given to the third party.
By the purchase in the shop Hemi-Sync-4eu.com, the Customer agrees with the preserving of the information about him/her and about his/her orders in the range mentioned above.
The customer has the right to ask for erasing his/her data that have been collected about him/her. The erasure will be carried out in 7 days after the receipt of the written request.
8) Cautions and Disclaimer
While many of our audio products contribute to wellness, they are not intended to replace medical diagnosis and treatment. DO NOT listen to Hemi-Sync® while driving or operating heavy equipment, or with other devices that may influence brain-wave activity.
If you have a tendency towards seizures, auditory disorders, or other adverse mental condition(s) DO NOT listen to Hemi-Sync® without first consulting your physician. In the unlikely event that you experience any unusual physical or mental discomfort, immediately discontinue use.
DO NOT reproduce Hemi-Sync® products or use with Dolby® or other noise-reduction systems. Doing so will diminish the effectiveness of the Hemi-Sync® signals.
All warranties whether express or implied, including warranties of merchantability and fitness for a particular purpose, are disclaimed.
