2) The titles and the main characteristics of the products and services
Sale of the CDs with the registered Hemi-Sync® technology by means of internet websites, or via e-mail. We have a right to trade, sale and store products with the Hemi-Sync® technology and we have made the proper contract with Interstate Industries, Inc., trading under the name of Monroe Products. 2-1) The characteristics of the products are stated clearly enough on the opening page of the e-shop. There is a description of every CD, taken from the Hemi-Sync.com web-site, by each of them. 3) The prices of the products or services, charges included, and their delivery costs
The total price consists of the price for the goods + packing charge + charge of postage. Before sending the order, the customer/user is informed of the total price as well as of the prices of the particular items. Charge of postage varies in relation to the way of payment (COD is more expensive) and to the quantity of the ordered products. The charges are much higher when products are sent abroad. Shipping and handling charges will be added to all orders.
Postage for delivery to the EU countries is from EUR 6,00 to EUR 9,50 (according to the amount and weight of goods) + EUR 1 packing charge. 3-1) Customers understand and they are familiar with the fact that prices for the products may change from time to time, mainly when Monroe Products changes prices or in the cases such as pretty sharp change in US Dollar exchange rate (compared to Czech Crown). If such a change of prices came into being, it would not affect previously made orders. 3-2) Where do we deliver? - Delivery Countries
We deliver to the EU countries: Austria, Belgium, Cyprus, Czech Republic, Denmark (except for the Faeroe Islands and Greenland), Estonia, Finland, France, Germany (except for the Helgoland Island and the Büsingen area), Greece, Hungary, Ireland, Italy (except for the municipalities of Livigna and Campione d'Italia), Lithuania, Latvia, Luxembourg, Malta, Monaco, the Netherlands, Poland, Portugal, San Marino, Slovakia, Slovenia, Spain (except for Ceuty and Melilly), Sweden, United Kingdom. 4) The Way of Payment, Delivery or Charging Process
a) Option of payment Cash on delivery is possible only for these countries: Greece, Hungary, Latvia, Portugal, Slovakia and Slovenia.
b) Payments via PayPay.com, bank transfer with a minimal transfer charge. If you have bank account then you can send money to anyone using PayPay.com. And also if you have not PayPay account. No credit card needed.
This is a worldwide payment system for sending / receiving micropayments via Internet by means of an email address. You can transfer money directly from your bank account or PayPay account. If you do not have your own account, you can create one in a few minutes.
c) Payments via Credit Card are made in co-operation with company 2checkout.com (2CO). Company 2CheckOut.com Inc. (Ohio, USA) is an authorized retailer for goods and services provided by Jiri Spacil. 2CO accepts customer orders via Visa, MasterCard, Discover, American Express, Dinners, JCB and debit cards with the Visa and MasterCard logo. 4-1) Orders of products become to be considered obligatory for both the contracting parties at the moment the order is sent via the electronic form by a customer. The customer has to fill in true information about him/her, mainly his/her name and surname, e-mail address and the address the ordered products should be delivered to. The customer has to state the sort and the quantity of the products he or she is ordering and the way of payment, by which he or she pledges to pay for the ordered goods. 4-2) Before sending the form, the customer is familiarized with the total price, the prices for particular items, of which the total price is consisted, included, and his/her attention is drawn to these Trading Terms and Conditions and they begins to be obligatory to him/her. 4-3) By sending the electronic form, the customer/user pledges to pay the total amount of money in the set point value. 4-4) Goods in stock is dispatched in 48 hrs. Goods out of stock can be firmly ordered in advance and such goods will be prepared for you in 30-40 days. As soon as your goods is prepared for you, we will inform you via email. 4-5) It is recommended for the customers to read through not only these Trading Terms and Conditions, but also the information in What You Must Know in order to understand better, which products are usually in stock and which sort of products is usually ordered at Monroe Products after sending the particular order made by the customer. 4-6) Products are delivered via mail service to the customer’s address. If the customer is not available when the package is being delivered, the package is kept at the post-office and the addressee is notified of keeping the package at the post-office by a written notice. If the ordered products were in stock before the order was sent, and they were not delivered within 21 days, customers are asked to contact the post-office, where his/her packages are usually kept, whether the package is kept there or not. The loss of written notification of keeping the package at the post-office is not rare. 5) Information of Withdrawal from Contract in accordance with law no. 367/2000, in accordance with §53, par 6, except for the cases mentioned in par 7
If a contract was made by way of the means of communication at distance, a customer has a right to withdraw from the contract within 14 days after receiving of the charging.
In accordance with the law no. 367/2000, according to § 53, par 7, letter d), the customer cannot withdraw from the contract for delivery of audio and video recordings and computer programs if he or she breaks their original package. 5-1) Customers have a right to withdraw from the contract within 14 days after receiving of the goods if they do not break the original package of music CDs. If you break the original package, it counts for nothing to demand withdrawal from the contract. The law is explicit in this instance. 5-2) If a customer has not broken the original package and he or she wishes to withdraw from the contract, he or she should follow the instructions mentioned below.
a) He or she must let the supplier know about his/her intention to withdraw from the contract via e-mail.
b) He or she must send the clear and intact product in its unbroken original package to the supplier’s address by registered mail. The customer must defray the cost of postage.
c) The goods must be sent in protective packaging in order not to come to damage of the product on the way to the supplier, otherwise the supplier may assume that the product had been damaged before it was sent and he may refuse to refund money to the customer.
d) The purchase document or its copy must be sent, together with the goods. 5-3) If the goods is returned in good order in accordance with the instructions above, the supplier will refund the amount of money that was paid for the goods. The amount of money will be returned to the customer. The way of payment will be arranged with every customer individually. 5-4) If anyone of the conditions above is broken, the supplier will not accept withdrawal from the consumer contract and the goods will be returned to the customer to his/her address. 6) Claims
In our online shop, we provide the same claiming conditions as in a usual shop. In accordance with the valid Czech Commercial Code and the Civil Code.
We provide a 90 days warranty for our goods (from the delivery date). This limitation is specified in conformity with VISA and MasterCard regulations. 7) Personal Data Protection
We fully respect customers' privacy and all our data are kept in secret and we use them only for the sales accounting service and for shipping the goods to the customer's address. No personal data will be used for any other purpose, neither given to the third party.
By the purchase in the Hemi-Sync-4eu.com, the Customer agrees with the preserving of the information about him/her and about his/her orders in the range mentioned above.
